WiFi jammer harms the interests of others

After Wang San opened the warehouse door, the police seized 3 wifi jammer, 2 of which were working. The police summoned Wang San to the investigation center of the Linhe District Public Security Bureau according to law.

After investigation, Wang San was in the business of buying and selling second-hand vehicles and mortgages. Because some car owners have installed GPS locators in the mortgaged vehicles, in order to shield the GPS signals of the mortgaged vehicles, Wangsan.com purchased the WiFi jammer and installed it in the warehouse. Afterwards, the police visited the surrounding residents, and everyone unanimously reported that the wireless signal was poor recently and the network could not be accessed normally.

Wang San installed a wifi jammer privately and interfered with the normal use of the network by others. His behavior violated the "Network Security Law". The network security team imposed a five-day administrative detention on him and a fine of 50,000 yuan.

This case is the first case of unauthorized use of WiFi jammers to interfere with the normal functions of other people's networks since the implementation of the "Network Security Law".

Article 27 of the "Network Security Law" stipulates: No individual or organization shall engage in activities that endanger network security, such as illegal intrusion into others’ networks, interference with the normal functions of others’ networks, and theft of network data; Programs and tools that endanger network security activities such as normal functions and protective measures, stealing network data; knowing that others are engaged in activities that endanger network security, shall not provide technical support, advertising promotion, payment and settlement assistance for them.

Article 63 stipulates: Violating the provisions of Article 27 of this law, engaging in activities that endanger network security, or providing special procedures and tools for engaging in activities that endanger network security, or providing technology for others to engage in activities that endanger network security Support, advertising promotion, payment and settlement, etc., which do not constitute a crime, shall be confiscated by the public security organs, detained for not more than five days, and fined not less than 50,000 yuan but not more than 500,000 yuan; if the circumstances are more serious, five In detention for more than one day but less than 15 days, a fine of 100,000 yuan to 1 million yuan may be concurrently imposed.
